Lawyer calls for investigation of Agege’s Consent Judgment instrument

An Ughelli based legal practitioner and Activist, Barr B.Amaworo has called for the investigation of the Consent Judgment paraded by Sen Ovie Omo-Agege as the legal instrument buoying the legitimacy of his candidature in the Feb 23 NASS election on the platform of the APC.
Reacting to the claims of Sen Ovie Omo-Agege in his interpretation of the Judgment of the Federal High Court, Asaba and the Appeal Court, Benin; wherein the senator claimed that the judgments had no impact on his candidature and that he remained the senator-elect, Amaworo said the Judgment given by the High Court in Kwale had restrained the APC from recognizing the Prophet Jones faction until the determination of the substantive suit and subsequently, the presiding Judge, Justice V.I. Ofesi ruled that the Ogodo led exco remained the duly elected leadership of the party.
He said since the Federal High Court, Asaba restrained the APC national chairman, Adams Oshiomhole from submitting any candidate list from Delta state to INEC and directed INEC from receiving any list from APC, “APC going ahead to present the names of Sen Ovie Omo-Agege, Revd Francis Waive, Charles Oniyere, Jaro Egbo and others, was in gross and willful violation of the Order of Court which is contemptuous.”
In that situation, he added, INEC which accepted the list was also in contempt of Court even though the APC produced a Consent Judgment before INEC accepted the list.
He said the Consent Judgment in question had been denied by Prophet Jones Erue and Cyril Ogodo who distanced themselves from it that they were not aware of the Consent Judgment and hence, the Consent Judgment should be investigated.
“Consent Judgment is an agreement of parties to settle over an issue, one of these same parties that were alleged to have signed the Consent Judgment filed another suit challenging the position of Prophet Jones as the Chairman of the state APC chapter which case was tried and decision taken.
“The question is, can you force a man to settle with you when the man says he cannot settle with you? That is what is playing out here. Sen Ovie Omo-Agege is forcing Cyril Ogodo to settle with him.
“Let us wait for the Appeal Court judgment, but if the judgment of the Appeal Court upholds the Judgment of the Federal High Court, Asaba, then the almighty Consent Judgment is Rumba Jumbo, just meant to cause a political brouhaha in the incorruptible APC.” Amaworo submitted.
