Judge fixes Ruling on Land Case involving members of Oluyah Family for October 9

The Commander, 371 Nigeria Air force Unit, Osubi, Delta State, Air Commodore Yakubu Dabo Daniel, Flight LT Chimaroke Onwuneme and four others have been dragged to the High Court of Justice, Orerokpe Okpe Local Government Area over a land issue involving some members of Oluyah family in Ughoton Community.
In Suit NO HOR / F/ 1 2018 between Dr Andrew Agbi as Plaintiff and Mr John Oduene, Mr Benson Egrake, Mr James Obaro, Mr Elohor Jakpa, Air Commodore Yakubu Dabo Daniel and Flt Lt Chimaroke Onwuneme as Respondents, the Plaintiff, Dr Agbi is seeking an order of perpetual injunction restraining the respondents particularly, the 5th and 6th respondents from further arresting or threatening to arrest him and to place a fine of one hundred million ( N100 millon ) on the respondents for their unlawful act, conduct and for the unlawful detention of the applicant.
In an affidavit deposed to by the Plaintiff, he alleged that on 13th February, 2018, he was in his farm at Odirehe Bush in Ughoton when the 6th respondent, Flt Lt Onwuneme in company of three other Air force men came in a Commando style and took him away after rigorous interrogation.
He further alleged that during the period of his arrest which lasted for several hours his phones were seized so as to bar him from making calls, adding that he was later told that the reasons he was arrested was that someone sold the land allegedly belonging to AVM Okorodudu.
However, in a counter affidavit, the respondents denied most of the allegations.
When the case came out on June 19th 2018 at the High Court of Justice Orerokpe, both Counsels, ( Barr Akubowe Esq for the Plaintiff and Chief ( Barr ) Andrew Asawota for the respondents agreed that the case should be adjourned till early next month for hearing.
But when the case came up recently, the trial Judge admitted the submission of both counsel and fixed ruling for October 9th, 2018.
